1. Introduction
These Terms & Conditions ("Terms") govern your use of our educational digital products and one-on-one business advising services ("Services"). By accessing or using our Services, you agree to be bound by these terms and conditions.
2. Our Services
We offer educational resources and personalized consulting to help you achieve your personal, professional, and business goals. Our Services include:
- Educational Digital Products: Access to online courses, workshops, templates, and other materials.
- One-on-One Business Advising: Personalized consulting sessions tailored to your specific needs.
- Group Business Advising: Consulting sessions with a group tailored to meet the needs of the group.
3. Your Responsibilities
- Scope: This relationship is not a legal partnership, instead more like a teacher-student or coach-athlete relationship. Each party must uphold their obligations for the consulting relationship to be successful.
- Active Participation: You agree to actively participate in our Services, engage in open communication, and be receptive to feedback.
- Implementation: You are responsible for implementing the techniques and strategies you learn. We provide guidance and support, but your success ultimately depends on your own actions. We do not provide any "done-for-you" services.
- No Guarantees: While we strive to provide valuable resources and advice, we cannot guarantee specific results. Your outcomes will depend on various factors, including your dedication, effort, and market conditions.
4. Term
The term of this Agreement shall commence upon your purchase of our Services and continue until terminated in accordance with these Terms.
5. Payments
Payments may be due in full upon purchase of our Services or we may offer a payment plan. If you are making a purchase with a payment plan then the total price of the Services will be divided equally among the number of months in your payment plan. Your month one payment will be paid immediately upon purchase, your following payments will be paid automatically on or around one month later, every month until your purchase is paid in full.
6. Refunds:
- General Refund Policy: We generally do not offer refunds for our Services, except as required by law. If you are dissatisfied with our Services and have a valid reason for a refund, please contact us to discuss your concerns immediately. You can stop using the Services at any time, but you will remain fully responsible for all payments and the full cost of your purchase, including all fees. No refunds will be given.
- Cancellation by Us: If we cancel your Services, any outstanding payments for Services that have already been provided will still be due in accordance with the original payment terms. Any payments you have already made for Services not yet rendered will be refunded to you pro rata, within 14 days.
- Final Sales: All sales are final. You agree and understand that changing your mind about the Services, failing to follow through or understand the details of the Services, not experiencing the results
7. Rescheduling [only applicable to 1:1 meetings]
- Notice: In the event of rescheduling, you agree to notify us by email at [email protected] as soon as you know you will not be able to attend your scheduled consulting session.
- Rescheduling Limit: You can reschedule your consulting session up to two times. You will receive an online scheduler to reschedule your session. We will make our best efforts to accommodate your request and reschedule the missed session as soon as possible.
- Time Limit for Rescheduling: Any rescheduled sessions must take place within six weeks of the originally scheduled session. Sessions not rescheduled within this timeframe will be forfeited.
- Rescheduling Limit: You may only reschedule a total of two times. If you reschedule twice and are still unable to attend your session, it will be forfeited.
- Late Arrivals: You understand that if you are late to a session, the session will complete at the originally scheduled time. If you will be more than 10 minutes late the session needs to be rescheduled.
- Late Arrival Forfeiture: You further understand that arriving more than ten minutes late to a session without prior notification by email to [email protected] will result in a forfeited session. You will not be given the chance to reschedule in this case.
8. Intellectual Property
All materials provided as part of our Services, including but not limited to online courses, worksheets, templates, and consulting notes, are our intellectual property. You may not reproduce, distribute, or modify them without our written consent.
9. Media Release & Testimonials
- Case Study: We may share your about your experience or results for training and marketing purposes.
- Proprietary Information: We will not share any proprietary information about your business publicly.
- Image: You grant us permission to take photos or videos while you are participating in the Services that we then may share on our website, in our advertising, and online courses.
- Testimonials: If you leave a testimonial you agree we can use the words, images, or videos on our website, in our advertising, and online courses.
- Compensation: You will not receive compensation now or ever for your appearance in the photos or videos we share on our website, in our advertising, and online courses.
10. Disclaimer & Limitation of Liability:
- No Guarantees: We do not promise specific results from our Services. You are responsible for your own outcomes.
- No Professional Advice: We do not provide medical, psychological, financial, or legal advice.
- Not Therapy: The Services are not a substitute for therapy or counseling.
- Client Responsibility: You are responsible for informing your mental health professional about the using our Services and for seeking appropriate professional help if needed.
- Liability Limitation: We are not liable for any damages or losses arising from your use of our Services, including but not limited to
- Indemnification: You agree to protect us from any legal claims arising from the Services.
- Governing Law: This agreement is governed by Washington state law.
- Dispute Resolution: In the event a dispute arises out of this Agreement and cannot be resolved by mutual consent, Disputes will be attempted to be resolved through mediation. Mediation can take place for up to 90 days after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party in any legal action will be entitled to be paid by the other party all costs and expenses incurred, including, but not limited to attorneys’ fees.
- Assignment: The Terms cannot be transferred.
- Severability: If any part of the Terms is invalid, the rest remains enforceable.
